Question: Does a rental contract in Mexico have to be in Spanish?
Answer: Yes. Spanish is the legal binding language in Mexico. The English column is just a courtesy.
Question: Are these contracts detailed enough to protect me and my property?
Answer: Yes. These contracts are very up to date with the latests laws, especially those laws meant to battle drug and arms traffickers, kidnappers, and car theives.
Question: How well do I have to read and understand Spanish to be able to fill out these contracts?
Answer: If you have just basic Spanish skills and can write the months of the year, addresses, numbers, they you should be able to fill out these contracts on your own if Spanish is your second language.
Question: Are you lawyers?
Answer: No. We are business people. We have had lawyers write and review our contracts.
Question: Are these contracts tested and proven?
Answer: Yes. We have rented more homes in more states in Mexico then many. We have used these contracts to evict renters, and we have used these rental contracts to establish excellent long term relationships with tenants.
Question: What if I need legal advice?
Answer: We don't offer legal advice. But at this time we are accumulating a library of real estate attorneys in many areas of Mexico. We will have a public list of real estate attorneys posted on this website shortly.
Question: What else do we need or should we do to feel safe after we sign the rental contracts with our tenants?
Answer: After you sign contracts with your tenant, we strongly recommend you maintain good communication with your tenant. But before you sign contracts, get scanned copies of your tenant's identifications, and check out all the information provided on the rental application, and if you have a weak applicant and still want to rent to them, consider having the tenant bring in a co-signer.
Question: Can I have you review the rental application for us?
Answer: Yes. We can do this for a small fee.
Question: Do residential contracts have to be recorded in the local register?
Answer: No. But each state has a maximum amount of time that a rental contract can be for without it being recorded. If you have a rental contract for one month or one year, you will be just fine.
Question: Is is recommendable to rent on a month to month basis in Mexico?
Answer: No. It is recommendable to have a start date and an end date. Many have found that a month to month lease doesn't establish when the contract is supposed to end and then a renter may be encouraged to keep renting as they see fit with the landlord not having an easy way to end the lease unless they bring in an attorney.
Question: What if I get the rental contract package and then I determine that I don't feel comfortable finishing filling out the rental contract?
Answer: Then we can help you finish preparing the rental contract and you only pay the difference in price between the package price and the custom price.
Question: Are you located in Mexico yourselves?
Answer: Absolutely. I have been property managing and renting propery in Mexico for over 15 years. I have handled hundreds of rental contracts, and have thousands and thousands of days working with tenants here in Mexico.
Question: What is the one piece of advice you can give a novice landlord in Mexico?
Answer: Get a solid rental application filled out by your potential tenant, get all identifications scanned and kept on file, and get a full security deposit from the get go.
Question: Is it safer to rent to a Mexican or a non-Mexican?
Answer: It is safest to rent to someone of good character. And then it is best to heighten the relationship with good communication.
