The Rental Application

The rental application is a vital part of qualifing your long-term renter in Mexico. The rental application will help you recognize a good renter when one presents themself, and will help you avoid problems later by renting to a weak applicant.

Your Mexico Rental Application asks for:

  • Full names, current addresses, cell phones, home phones, work phones, and email addresses.
  • Social Security number if applicable.
  • Mexican Citizen voting "credencial," or legal Mexican immigration documents such as a FMT (tourist visa), FM3 or FM2.
  • Driver's License numbers for all applicants no matter what country they are from.
  • Make, year of car, and license plate numbers for all cars if applicable.
  • Income?
  • Position?, Since how long?
  • Spouse's Employer and pertinant questions.
  • Previous Employer and pertinant questions.
  • Filed for Bankruptcy?
  • Okay to run a credit check?
  • Have you ever refused to pay rent?
  • Can income be shown with recent checks or bank statements?
  • Additional verifiable income?
  • Monthly expenses
  • Alimony and child support.
  • Credit card expenses.
  • Mortgage expenses.
  • Auto expenses.
  • Insurance Expenses.
  • Personal references.

The Rental Contract - One for Every State in Mexico

Below is an outline of the Mexico Rental Contract.

The Rental Contract is written in both English and Spanish and has many clearly written but important clauses that outline the rules of the tenancy that fairly protect both the landlord and tenatn. In addition to being a legal contract, the rental contract also helps eliminate misunderstandings during the rental period.

Included in the Mexico Rental Contract Package is a sample Mexico rental contract that has all the blanks hand filled in already for you to use as a template to better understand how to fill in the contract correctly.

Here is what is included in the English Spanish Mexico Rental Contract:

  • Landlord and tenant named.
  • The property address is stated.
  • The contract states that the lanlord leases the property to the renter in exchange for money, which clarifies why the rental contract exists.
  • The contract designates which Mexico state's civil code is to be used.
  • The Landlord declares to be the legitimate owner of the said property and has the legal means to lease the property.
  • The renter declares to be of sound mind, and has the legal and financial capacity to enter into this rental contract.
  • Duration of the lease. Simply fill in the move-in and move-out dates.
  • Montly rent. Simply write in the US dollar amount or the Mexican peso amount.
  • Late fees and on what date they are incurred. Fill in the blanks.
  • Which utility bills are not included in the lease.
  • A clause which states that the utility bills are to stay in the name of the owner. This is to protect the owner's possesion of the property.
  • Financial obligations of the renter if the renter does not want to complete the rental contract.
  • How rent is to be paid. For example, rent may be paid by US bank check mailed to a stated address, or by direct deposit, or however the landlord and renter agree upon. Check the appropiate box.
  • Common issues concerning the security deposit.
  • Who the renter should contact when issues arrive, either the landlord or property manager. Fill in the blanks with the name and contact information. so if there is a leak, the renter can't say they didn't know who to contact and not be responsible for damage.
  • The co-signer, if any, is addressed, and it designates what property of the co-signer will be used as collateral if the tenant does not complete their contractual obligations.
  • Common restrictions of the house and community is addressed.
  • Guests and their limitations.
  • The issues concerning “Jucio Autonomo de Extincion de Dominio” is address by stressing that no drug activity, auto theft, kidnapping, and arms possession can occur at the premisses. This is new and must be carefully written into every contract.
  • No subletting and no assigning is addressed.
  • No alterations can be made to the premises unless otherwise agreed upon in writing is addressed.
  • Common maintenance such as cleaning is addressed.
  • Property Loss, Damage, and Personal Injury clause to protect the landlord.
  • 24 hour notice, unless otherwise agreed upon, for the landlord or property manager to enter and inspect the premises is addressed.
  • Default for non-payment of rent is addressed.
  • Legal Fees and Expenses to be reimbursed by renter to the landlord if the lanlord evicts the renter is addressed.
  • A common severability Clause is included.
  • Date and signatures.


The Inventory Sheet

This inventory sheet is a check list in Spanish and English so even your cleaning person can fill it out for you. It covers not only inventory, but also the condition of the inventory, all on one easy and complete list.

This inventory sheet starts in the kitchen, and then makes its way through the house including bedrooms, bathrooms, living and dining areas, patios, front entry, garage, walk-in closets, swimming pool if there is one, and more. This inventory lists includes well over 100 items to check. It also asks the cleaning team to check for leaks, light bulbs, and the condition of many moving parts such as air conditioning, garage doors, windows, doors, microwave, and etc.
